Terms of Service

Welcome to EzStreams. These Terms of Service (“Terms”) govern your access to and use of EzStreams’ internet radio automation platform, websites, and services (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms.

1. Description of Service

EzStreams provides a cloud-based internet radio automation platform that enables users (“Broadcasters”) to create, manage, and stream online radio stations. Our Service includes:

  • Audio streaming infrastructure (Icecast/Liquidsoap)
  • Automated playlist scheduling and management
  • Music library hosting and organization
  • Voice tracking capabilities
  • Embeddable player widgets
  • Listener analytics and reporting
  • PRO reporting tools for royalty compliance

2. Account Registration

To use EzStreams, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use our Service.

3. Subscription and Payment

EzStreams offers subscription-based services. By subscribing, you agree to:

  • Pay all applicable fees as described at the time of purchase
  • Provide valid payment information through our payment processor (Stripe)
  • Authorize recurring charges for subscription renewals unless cancelled

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms. We reserve the right to change our pricing with 30 days’ notice.

4. Music Licensing and Copyright Compliance

Important: EzStreams does NOT provide music licensing. As a Broadcaster, you are solely responsible for:

  • Obtaining all necessary licenses to broadcast copyrighted music
  • Complying with Performance Rights Organizations (PROs) such as ASCAP, BMI, SESAC, and SoundExchange
  • Maintaining proper licensing agreements for your broadcast territory
  • Submitting required royalty reports to applicable organizations
  • Paying all royalty fees owed to rights holders

We provide PRO reporting tools to help you generate reports for SoundExchange, ASCAP, BMI, and SESAC, but submission and payment remain your responsibility.

5. DMCA Compliance

EzStreams complies with the Digital Millennium Copyright Act (DMCA). Our platform includes features to help you maintain DMCA compliance, including:

  • Artist/album repeat protection settings
  • Song request time restrictions
  • Play history logging

You agree to comply with DMCA requirements, including but not limited to:

  • Not announcing songs in advance
  • Not playing more than 3 songs from the same album or 4 songs from the same artist within a 3-hour period
  • Not publishing advance playlists

6. Acceptable Use Policy

You agree NOT to use the Service to:

  • Broadcast content that infringes on intellectual property rights
  • Stream illegal, obscene, defamatory, or harmful content
  • Broadcast content that promotes violence, hatred, or discrimination
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any systems
  • Use the Service for any unlawful purpose
  • Resell or redistribute the Service without authorization
  • Exceed your subscription’s bandwidth or storage limits

7. Content Ownership

Your Content: You retain ownership of all audio content, music files, and materials you upload to EzStreams. By uploading content, you grant us a limited license to store, process, and stream your content as necessary to provide the Service.

Our Content: EzStreams and its licensors own all rights to the Service, including software, design, trademarks, and documentation. You may not copy, modify, or create derivative works of our Service.

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may temporarily suspend the Service for:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency repairs
  • Security concerns
  • Circumstances beyond our reasonable control

9. Termination

By You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

By Us: We may suspend or terminate your account if you:

  • Violate these Terms
  • Fail to pay subscription fees
  • Engage in fraudulent or illegal activity
  • Broadcast content that violates copyright law

Upon termination, your right to use the Service ceases immediately. We may delete your data 30 days after termination.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EZSTREAMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless EzStreams, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including copyright
  • Content you broadcast through the Service

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Virginia.
